Welcome to Whitespace. These Terms of Service ("Terms") govern your use of the Whitespace mobile application and related services (collectively, the "Service"). By using Whitespace, you agree to these Terms.
1. ABOUT WHITESPACE
Whitespace is a personalized meditation and audio wellness application. The Service uses artificial intelligence to generate customized audio sessions based on your inputs, preferences, and stated intentions. Sessions are created using third-party text generation and voice synthesis technologies.
2. ACCOUNT REGISTRATION
2.1 Eligibility
You must be at least 13 years old to use Whitespace. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
2.3 Anonymous Use
You may use certain features of Whitespace without creating an account. Anonymous usage is subject to these Terms. If you later create an account, your anonymous data may be linked to your account.
3. CREDITS AND SUBSCRIPTIONS
3.1 Credit System
Whitespace uses a credit-based system for generating personalized audio sessions. Different session lengths and formats require different numbers of credits. The number of credits required for any session is displayed in the app before generation.
Session durations are approximate. Actual output length may vary based on content, pacing, and your experience level settings. Credit requirements may change as the Service evolves.
3.2 Free Credits
New users may receive complimentary credits upon signup or email verification. Additional credits may be earned through referral programs or promotional offers. Free credits are subject to availability and may be modified or discontinued at any time without notice.
3.3 Subscription Plans
Whitespace offers one or more subscription plans that provide recurring credits and access to premium features. The specific plans, pricing, credit amounts, and benefits available to you are displayed in the app at the time of purchase.
Subscription prices are in US dollars and may vary by region. Prices are subject to change with notice.
3.4 Credit Expiration and Rollover
- Subscription credits are granted at the start of each billing cycle
- Unused credits may roll over for a limited period, as described in the app
- Rolled-over credits expire at the end of the applicable rollover period
- Credits have no cash value and cannot be transferred between accounts except as explicitly permitted
3.5 À La Carte Purchases
Individual credit packs may be purchased without a subscription. Credit pack pricing and quantities are displayed in the app at the time of purchase. Purchased credits do not expire but have no cash value and are non-transferable.
3.6 Billing and Renewal
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase
- Manage subscriptions and turn off auto-renewal in your device's account settings
3.7 Cancellation
You may cancel your subscription at any time through your device's account settings. Upon cancellation:
- You retain access to subscription benefits until the end of the current billing period
- Unused credits remain available until they expire per Section 3.4
- No refunds are provided for partial billing periods
3.8 Refunds
Refund requests are handled according to Apple App Store and Google Play Store policies. We do not provide direct refunds for in-app purchases.
4. GIFTS AND GIFT CREDITS
4.1 Purchasing Gifts
Whitespace may offer the ability to purchase gifts in the form of credits or time-limited access for others. Gifts are not subscriptions for the purchaser. Gift options and pricing are displayed in the app at the time of purchase.
Gift purchases are final and non-refundable once the gift code is generated.
4.2 Gift Codes
- Gift codes are valid for the period specified at the time of purchase
- Codes may only be redeemed once
- Lost or stolen codes cannot be replaced
- The purchaser may not redeem their own gift code
4.3 Gift Redemption
When a gift is redeemed, the recipient receives the associated credits or access immediately. Gift recipients must agree to these Terms upon redemption.
4.4 Scheduled Delivery
Gifts may be scheduled for future delivery. We are not responsible for delivery failures due to incorrect recipient information.
5. REFERRAL PROGRAM
5.1 Earning Referral Credits
You may earn credits by referring new users to Whitespace. Referral rewards and the conditions for earning them are described in the app.
5.2 Referral Limits
To prevent abuse, referral rewards are subject to rate limits. Current limits are displayed in the app and may be adjusted at any time.
5.3 Prohibited Referral Activities
The following are prohibited and may result in forfeiture of credits and account termination:
- Self-referrals or creating multiple accounts
- Automated or bot-generated referrals
- Fraudulent or deceptive referral practices
- Purchasing or selling referral codes
6. USER CONTENT AND CONDUCT
6.1 Your Inputs
You retain ownership of the text inputs you provide (intentions, goals, preferences). By submitting inputs, you grant Whitespace a license to use them for generating your sessions and improving our Service.
6.2 Generated Content
Audio sessions generated by Whitespace are created for your personal, non-commercial use. You may:
- Listen to your sessions on any personal device
- Download sessions for offline personal use
- Share sessions with friends and family for personal use
You may not:
- Sell, license, or commercially distribute generated sessions
- Use generated content to train AI models
- Remove or alter any attribution or metadata
- Claim generated content as entirely your own original creation
6.3 Prohibited Uses
You agree not to use Whitespace to:
- Generate content that is harmful, abusive, or illegal
- Attempt to bypass usage limits or security measures
- Interfere with or disrupt the Service
- Violate any applicable laws or regulations
7. INTELLECTUAL PROPERTY
7.1 Whitespace Property
The Whitespace name, logo, app design, underlying technology, and all original content are owned by Whitespace or its licensors and protected by intellectual property laws.
7.2 Third-Party Services
Whitespace uses third-party services for text generation, voice synthesis, data storage, and subscription management. Your use of Whitespace is also subject to these providers' terms of service.
8. DISCLAIMERS
8.1 Not Medical Advice
Whitespace is a wellness tool, not a medical device or treatment. The Service is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. Always consult qualified healthcare professionals for medical concerns.
8.2 AI-Generated Content
Sessions are generated by artificial intelligence and may occasionally produce unexpected, inaccurate, or inappropriate content. We continuously work to improve quality but cannot guarantee perfection.
8.3 Service Availability
We strive for high availability but do not guarantee uninterrupted access. Session generation depends on third-party services that may experience downtime.
8.4 No Warranty
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITESPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO WHITESPACE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. INDEMNIFICATION
You agree to indemnify and hold harmless Whitespace, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. CHANGES TO TERMS
We may modify these Terms at any time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the modified Terms.
12. TERMINATION
12.1 By You
You may stop using Whitespace at any time. To delete your account and data, use the account deletion option in Settings or contact us.
12.2 By Us
We may suspend or terminate your account for violations of these Terms, fraudulent activity, or as required by law. We may also discontinue the Service with reasonable notice.
12.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited. Provisions that by their nature should survive termination will survive.
13. DISPUTE RESOLUTION
13.1 Informal Resolution
Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
13.2 Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
13.3 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class actions.
14. GENERAL PROVISIONS
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Whitespace regarding the Service.
14.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
14.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver.
14.4 Assignment
You may not assign these Terms. We may assign our rights and obligations without restriction.
